There's Nothing In The Rulebook For This Contingency
-
The dilemma in this fatal vehicle crash comes from the vehicles involved: a scooter and a motorized wheelchair. The guy in the wheelchair collided with a guy on a scooter, and the guy on the scooter died. And now, it's a question whether the wheelchair is a "vehicle" to be treated like a car, or whether it's more like a pedestrian case. The difference is significant in what the cops will charge the wheelchair guy with: If he's a "pedestrian," he might get a jaywalking charge ("walking" being a relative term). If he was on a "vehicle," it could be reckless driving. And the case might hinge on the size of the motor. (St. Petersburg Times)
