That's exactly what's happening in this Australian case, in which a woman claims a) her mother requested a Caesarian and the doctor didn't comply, and b) her difficult birth led to her erb's palsy, an arm paralysis generally caused during childbirth. The woman's 26 now, so it's been a long time. Is a failure to do a C-section in that case a cause for legal action? (Sydney Daily Telegraph)
