The Second Circuit Court of Appeals has struck down part of the Defense of Marriage Act as unconstitutional and in the process has defined gays and lesbians as a protected class. I'm sure you'll have no problem figuring out how to talk about this, whichever side you're on. I'll just point out that the case involved an 83-year-old widow whose same-sex spouse -- they were legally married in Canada and lived in New York, which recognizes same-sex marriages -- died, and who was facing a $363,000 estate tax bill if DOMA was applied and she wasn't recognized as a spouse for inheritance purposes. It's hard to argue that she should have to pay. And the Chief Judge who wrote the opinion was a G.H.W. Bush appointee, in case you're inclined to rail against "liberal judges." (Los Angeles Times)
