Open A Store There And This All Goes Away

There is no Trader Joe's store in Vancouver, BC. There IS one in Bellingham, WA, across the border. So an entrepreneur opened a storefront in Vancouver and began to drive across the border, fill up his van with Trader Joe's stuff, drive back, and resell it as "Pirate Joe." The real Trader Joe's is threatening legal action. He doesn't care. He thinks he has the right to do what he's doing, because it's not clearing out the Bellingham store of goods -- he buys stuff at other T.J.s, too, spreading it out -- and, well, if Trader Joe's isn't selling in Vancouver and he can sell the stuff at a markup but still undersell other grocers with similar goods, and he doesn't represent himself as being the real Trader Joe's, should he be allowed to do it? Or is he unfairly appropriating Trader Joe's goods and image? (Los Angeles Times)
