Can a reality TV show barge into the operating room while you're in there being treated, take video of it blurring your face but leaving your voice and other identifying characteristics intact, and air it for a profit without your approval? According to this article, if appeals fail, the answer is yes. A reality show that aired on ABC used footage of a man dying in the OR after he was hit by a garbage truck; they never got permission from him or his family, and his wife happened to see it on TV. It's shameless, but the show argued that it could do it because, technically, it was produced by ABC News and so fit under the news exception (even though the show itself wasn't a news show). You'd think HIPAA would stop this, but not so far. (ProPublica with the New York Times)
