The cell phone battery was dead and it was properly stowed away in a cubby hole in the car. So why was the driver guilty of violating the British Columbia hands-free law? Because he was wearing ear buds connected to the phone. The judge decided that even if he couldn't use the phone because it was inoperable, if he plugged the earbuds in, he would have had to hold it in a way it COULD be used, even if it, um, couldn't. Is that a coherent reason to find someone guilty? What if he plugged the buds in before hitting the ignition? What if they were wireless earbuds? Why was he wearing ear buds if the phone was dead, anyway? So many questions. (CTV News)
