Restrictive covenants in real estate deeds are unenforceable, so the issue in the case of a couple ready to buy their dream home who found a racist restriction in the deed isn't that they can't buy the house. It's how to get that clause out of the paperwork. They can file a document to amend the deed, but they don't even want that clause anywhere near the documentation. It shouldn't be hard to have the seller just file a statement and then file a revised deed without the clause, but there seems to be a hangup with that, because the buyer feels strongly that he doesn't want to sign the document even if the clause is invalid and they can change it later. Come on, legal minds, this can be fixed. (KTXL-TV/Sacramento)
