FCC Fines FM Auction Winner For Late Post-Auction Long-Form Application

The FCC has proposed a fine of $3,000 against JOSEPH C. TESIERO arising from his application in Auction 91 for a new FM at SPECULATOR, NY, but granted his request for a waiver of the deadline for filing the post-auction Form 301 long-form application and has granted the application.
TESIERO applied for, and won the auction for, the new FM facility, but missed the deadline for filing the Form 301, JUNE 30th, 2011, by almost a month (JULY 26th). He asked for a waiver, saying that he was without assistance of counsel and was "preoccupied with the construction of another station and issues related to his non-broadcast business." While the Commission agreed that TESIERO did not show bad faith and the late filing did not significantly delay or materially adversely affect the licensing process, his admission to being late made him subject to the fine.
