Scott And B.R. Win Arbitration Over Alleged Contract Breach By XX 1090

SCOTT KAPLAN and BILLY RAY SMITH have won $490,638 in damages in an arbitration over the alleged breach of their contracts by BCA Sports XEPRS-A (XX 1090)/SAN DIEGO, reports U-T SAN DIEGO.
KAPLAN was fired in FEBRUARY in the wake of comments on a JANUARY 25th show about a female sportscaster; SMITH, his longtime partner in mornings at the station, was subsequently fired, but an arbitrator, retired judge LINDA QUINN, has ruled that the pair's contracts required a specific procedure to be followed and that the station failed to follow the proper process, which would have offered KAPLAN a chance to apologize. KAPLAN's attorney DICK SEMERDJIAN told the U-T that BCA has not paid and has filed a motion for reconsideration.
"I feel vindicated," SAID KAPLAN, who, with SMITH and AMBER MESKER, now hosts a video show online for the U-T, told the paper. "They breached the contract. I knew that from the beginning. There was a lot of embarrassment that came with the termination. I spent 11 great years on the radio. ... I loved what I did and I loved who I worked for."
