FCC Fines Miami Unlicensed FM Operator (Again)

The FCC has fined GARY M. FELDMAN $25,000 for operating an unlicensed radio station on 97.7 FM in MIAMI.
Agents observed the station transmitting from FELDMAN's house and identified on the air as "hot977fmmiami.com." FELDMAN allegedly admitted operating the station but did not relinquish or destroy his equipment; the station was later observed emanating from a commercial building in MIAMI. FELDMAN was previously fined $10,000 for operating a pirate FM in TAMPA, and the FCC says that fine remains unpaid.
In addition, the Commission denied an appeal by TOWER INVESTMENT TRUST, INC. of its denial of a power increase for Contemporary Christian WBNK/PINE KNOLL SHORES, NC. The Commission ruled that the applicant failed to show that overlap with NEXTMEDIA Adult Hits WERO (BOB 93.3)/WASHINGTON, NC could not be eliminated by a directional antenna and therefore did not grant a waiver of interference standards; TOWER had claimed that the overlap area, water and wetlands, is and will probably remain uninhabited and the power increase would help with seasonal interference from "ducting."
The Commission also denied an Application for Review of the dismissal of the construction permit for unbuilt KWFA/TYE, TX by MARLENE V. BORMAN.
And the FCC also adopted a Consent Decree with VISION LATINA BROADCASTING, INC., licensee of Spanish Religion KBPO-A/PORT NECHES, TX, and CHRISTIAN MINISTRIES OF THE VALLEY, INC., lessee and buyer of the station, for various infractions including a late license renewal application, inadequate fencing at the transmitter site, and alleged unauthorized transfer of control. The parties will make a "voluntary contribution" of $10,000 to the U.S. Treasury and will consummate the sale of the station to settle the matter.
