FCC Rejects Challenge To WTOK Sale

The FCC has denied RAAD BROADCASTING CORP.'s Petition for Reconsideration of MSG RADIO, INC.'s sale of Spanish Top 40/Rhythmic WTOK-F (HOT 102)/SAN JUAN (formerly WIAC-F) to WIAC-FM, INC.
RAAD objected to a waiver to allow the buyer, owned by members of the SOTO family, to own the station under contour-overlap analysis, contending that there had been an unauthorized transfer of control and that the licensing of a station slogan indicated common control of the station without authorization. The Commission noted that the fundamental issues of the case had already been decided and that the initial objection was not dismissed in an arbitrary or capricious manner.
