WHPT Sued Over Use Of Man's Picture On Website

COX MEDIA GROUP Talk WHPT/TAMPA, FL is being sued for posting an photograph on its website of a young man with Down's Syndrome, holding a drawing which was altered to become a sign that read "Retarded News."
COURTHOUSE NEWS SERVICE reports that ADAM HOLLAND and his family are also suing the company that distributed the original photo online and the FLICKR user who originally uploaded the photo with a caption reading "just a stupid photo of the sick retarded kid that lives down my street that my dogs hate."
The altered photo was used on a page for THE COWHEAD SHOW, and PD MICHAEL SHARKEY's apology letter to the man's mother saying that the picture would be removed was included with the complaint.
The plaintiffs are seeking damages for damages for invasion of privacy, defamation, intentional infliction of emotional distress, misappropriation of likeness, and violations of the TENNESSEE Personal Rights Protection Act.
