FCC Denies Appeal Of FM Translator Application Dismissals

The FCC has denied GERALD R. PROCTOR's Petition for Reconsideration of the Commission's dismissal of his applications for FM translator construction permits in WILLIS and CLEVELAND, TX.
PROCTOR filed for the translators in the Auction 83 filing window, but the Commission said that he did not file the required cap showing for two of nine applications he filed under the auction, instead stating, "Commission Rules and Regulations have changed and evolved to the point where understanding those changes and... instructions present a real challenge. What was once relatively simple has now become very complex and -- to me -- extremely confusing." The commission rejected PROCTOR's argument that his confusion is a valid excuse that should allow him to amend his applications.
