FCC Rescinds Upgrade For Virginia Noncommercial FM

The FCC has rescinded the grant of an upgrade for EASTERN MENNONITE UNIVERSITY noncommercial WEMC/HARRISONBURG, VA, agreeing with STU-COMM, INC. that the Commission's normal practice and policy has been to have permittees wait until the day after the day a construction permit expires to file a replacement modification application for the same station.
EMU filed its replacement permit 30 seconds after the expiration of the original permit (3a (ET) on FEBRUARY 11, 2011); STU-COMM filed a competing minor change application for first-adjacent WNRN/CHARLOTTESVILLE on FEBRUARY 14th, the next business day. The Commission disregarded STU-COMM's failure to file an informal objection earlier in the proceeding because of the public interest aspect of considering its objection.
