BERNARD DALLAS, LLC is selling KFCD-A/FARMERSVILLE, TX and KHSE-A/WYLIE, TX to MARK JORGENSON's ACM DALLAS V LLC (DALLAS AM BROADCASTING, LLC) for $475,000 plus an LMA before closing.
In other filings with the FCC, SHEILA CALLAHAN & FRIENDS, INC. is selling K237DZ/MISSOULA, MT to EDGEWATER BROADCASTING for $40,000.
BIRACH BROADCASTING CORP. has filed for Silent STAs for WVAB-A/VIRGINIA BEACH, VA and WPON-A/WALLED LAKE, MI while it awaits zoning approval for the stations' new facilities.
KBDX LLC has filed for a Silent STA for K244FB/EAST SALT CREEK, CO due to limited power supply.
GEOS COMMUNICATIONS has closed on the sale of noncommercial News-Talk-Classical WXLE/INDIAN LAKE, NY to THE ST. LAWRENCE UNIVERSITY (NORTH COUNTY PUBLIC RADIO) for $20,000. The buyer already programs the station under an LMA.
DIANE DYER and JOHN EMBRY have closed on the transfer of half of their 50% interests in BEECH TREE PUBLISHING INC., licensee of Classic Hits WLBQ-A-W268CE (Q101.5)/MORGANTOWN, KY, to BRENDA J. LONGHOFER and CONNIE S. RENFROW for forgiveness of $25,000 each in loans. The four parties now each own 25% of the company.
And EDUCATIONAL MEDIA FOUNDATION has closed on the sale of W291CJ/MARQUETTE, MI, W254AG/ESCANABA, MI, and W260AG/ISHPEMING, MI to GREAT LAKES RADIO, INC. for $1.
The Commission dismissed YUPIIT SCHOOL DISTRICT's appeal of the cancellation of its license for noncommercial KHKY/AKIACHAK, AK due to failure to file a license renewal application.
The FCC has also denied FONDREN COMMUNITY VOICES' amendment seeking reconsideration of the denial of its application for a new low power FM at JACKSON, MS. After two mutially exclusive applications competing with FONDREN were amended to allow its application to proceed as a singleton, the application was rejected because the applicant "did not provide any documentation with the Fondren Application indicating its organizational status as required by FCC Form 318. Instead, it provided an educational purpose narrative that did not state its organizational form or whether it had received state certification or recognition." FONDREN argued in its amendment application that it is unincorporated and that MISSISSIPPI law recognizes such entities, but the Commission insisted that according to the letter of its rules, applicants "must submit complete copies of the documents establishing their nonprofit status, such as corporate charters or articles of incorporation. Applicants that fail to provide these materials are subject to dismissal." Unincorporated entities may submit a letter from a licensed local attorney citing the proper recognition statute, but the Commission said that FONDREN had not met the burden of showing that it complies with MISSISSIPPI law requirements.
