iHeartMedia Faces Suit In Illinois Over Text Ads

iHEARTMEDIA faces a lawsuit over text message marketing filed in COOK COUNTY Circuit Court in CHICAGO, reports the COOK COUNTY RECORD.
Plaintiffs NICHOLAS WILLIS of ILLINOIS and BETH SHVARTS of NEW YORK filed the suit as a putative class action on FEBRUARY 19th, claiming that iHEARTMEDIA responded to song request texts by sending ads for third-party sponsors back, tacked at the bottom of texts thanking them for their correspondence.
The suit, which seeks actual and statutory damages and attorneys' fees plus injunctive relief, alleges that “iHEARTMEDIA’s invitation to sent text messages to these short codes essentially serves as a ‘back door’ method to acquire cellular telephone numbers and advertise iHEARTMEDIA’s sponsors’ products and services.”
