FCC Fines FM Auction Winner For Late Post-Auction Long-Form Application

The FCC has fined ALFRED L. “PAT” ROBERSON III $3,000 for failing to timely file his post-auction Form 301 long-form application for a new FM at ELAINE, AR won in FM Auction 93. ROBERSON filed almost a month late, was granted a waiver of the filing deadline to allow for acceptance of his application and payment of the filing fee, but was fined for missing the deadline in the first place and his response to the initial Notice of Apparent Liability for Forfeiture was also late.
In addition, the Commission dismissed COX MEDIA GROUP Urban AC WALR-F (KISS 104.1)/GREENVILLE-ATLANTA, GA's permit to change its Community of License to PALMETTO, GA and downgrade from Class C0 to Class C1 closer to ATLANTA. RADIO TRAINING NETWORK, licensee of Contemporary Christian WVFJ-F (THE JOY FM)/GREENVILLE, GA objected to COX's move, saying that the permit had expired after three years, despite COX's claims that the change to the table of allotments does not take place until the modified facilities are licensed; RTN said that the permit had a Special Operating Condition that clearly amended the table, and that the WALR change needed to protect WVFJ but was short-spaced.
In addition, WVFJ's own upgrade was contingent on WALR constructing and filing the license application for its originally-applied-for C1 facility, but after WVFJ went ahead and built its new site and filed for its license and STA, WALR filed an amendment to go back to its old site with a Class C0 facility; RTN contended that the PALMETTO move meant that the old site and C0 classification had lost their grandfathered short-spacing permissions against two other stations.
