Viacom's Dauman And Abrams Want 'Immediate Medical Evaluation' Of Sumner Redstone

Papers filed by attorneys for VIACOM Chairman/CEO PHILIPPE DAUMAN and board member GEORGE ABRAMS in their suit challenging their removal from former Chairman SUMNER REDSTONE's trust call for REDSTONE to undergo an "immediate medical evaluation" because, they charge, his deterioration may mean he cannot provide evidence in the case, reports the LOS ANGELES TIMES.
DAUMAN's lawyer JOSEPH L. BIERWITH JR. wrote in the filing that REDSTONE "is a 93-year-old man suffering from overwhelming physical ailments, including an inability to speak, stand, walk, eat, write or read. He suffers from a progressive neurological disease characterized by dementia." The filing rejects evaluations by UCLA psychiatrist Dr. JAMES SPAR submitted by REDSTONE's lawyers on FRIDAY that declare REDSTONE has mental capacity to make the changes in his trust, calling the doctor's submission "a one-sided, uncross-examined and distorted view of Mr. Redstone’s mental condition.... (that) reads like an interview or deposition summary, as if Mr. REDSTONE was capable of conducting a conversation,” although, BIERWITH adds, "Mr. REDSTONE is unable meaningfully to speak at all."
DAUMAN and ABRAMS are fighting their ouster from the trust that will manage REDSTONE's affairs when he dies or is declared incompetent. The plaintiffs suggest that their removal was prompted by REDSTONE's daughter, VIACOM/CBS CORPORATION Vice Chair SHARI REDSTONE, who has taken an increased role in her father's business after he fended off a lawsuit by his former girlfriend MANUELA HERZER, who he had fired as his health-care representative.
And TODAY, REDSTONE's NATIONAL AMUSEMENTS INC., which holds the controlling stake in both VIACOM and CBS CORPORATION, amended its bylaws to require unanimous approval of VIACOM board members for that company to sell PARAMOUNT PICTURES, a move that REDSTONE has been against while DAUMAN has said he would consider selling a minority stake in the studio by JUNE 30th.
