Court Allows Defamation Suit Appeal Against Air America, Rhodes To Proceed

A defense contractor's defamation suit appeal against AIR AMERICA RADIO and RANDI RHODES has been approved to proceed by a federal bankruptcy court.
CACI INTERNATIONAL INC. sued RHODES, the network and AAR parent company PIQUANT LLC in 2005 over comments RHODES made on her AUGUST 25 and 26, 2005 shows accusing CACI employees of raping and murdering IRAQI civilians at ABU GHRAIB; the suit was dismissed by U.S. District Court, but CACI's appeal was frozen by the bankruptcy filing.
The company seeks $1 million in compensatory damages and $10 million punitive damages and needed the court to approve the appeal after the network filed Chapter 11 bankruptcy. The plaintiff used the fact that an insurance policy would cover any award of damages to receive approval.
