Future Of Music Coalition Asks FCC To Examine Clear Channel Rights Waiver

The FUTURE OF MUSIC COALITION today asked the FCC to issue a declaratory ruling "to resolve any possible uncertainty as to the applicability of the commission's sponsorship identification rules to certain broadcast programming carried by CLEAR CHANNEL." Specifically, FMC wants the FCC to rule that, based on existing Commission rules, artists who waive digital performance rights in exchange for broadcast of their music are sponsoring the broadcast and much be identified as such, or else it constitutes payola.
Back in JUNE (NET NEWS 6/22), FMC accused CLEAR CHANNEL of forcing musicians to give up their digital copyrights to get the airplay the radio giant is required to give under the payola consent decree governing the broadcasters' operations; CLEAR CHANNEL denied the allegation.
