Report: FCC, Justice Dept. To Appeal Indecency Case To Supreme Court

The Justice Department is asking for an extension until NOVEMBER 1st to file an appeal of the Second Circuit indecency ruling to the Supreme Court. BROADCASTING AND CABLE magazine reports that the filing of the extension request contains the news that Solicitor General PAUL CLEMENT has decided to go ahead with the appeal and needs extra time to generate the petition.
A previous extension had already been granted in the matter, but the Justice Department, which will argue the case for the FCC, had heretofore not indicated whether it would go ahead with the appeal, which would forego appeal to the full Second Circuit court in favor of immediately taking the case to the highest court.
