FCC Nixes Challenge To WWFS/N.Y. License

The FCC has denied a petition to deny the license of CBS AC WWFS (FRESH 102.7)/NEW YORK filed by individuals and an organization still steamed about the infamous 2002 OPIE AND ANTHONY "Sex for SAM" stunt when the station was still Talk WNEW.
REV. GIACOMO CAPOVERDI, NICK CARLUCCI, GRACE VERTULLO and TFP STUDENT ACTION filed the petition, arguing that a 2006 consent decree that settled the indecency cases involving O&A, HOWARD STERN and others, while wiping the record clean, was invalid because it was not approved by Congress and was not offered to minority-owned broadcasters facing license problems. The Commission rejected those arguments, upholding its right to settle the case with a consent decree and noting the differences in the decade-old cases with the minority-owned stations, which did not involve indecency.
