Martin: Sat Merger Faces 'High Hurdle,' May Still Be Decided In Q1

Asked about the XM-SIRIUS merger by reporters TUESDAY morning, FCC Chairman KEVIN MARTIN declined to reveal much about the status of the application, repeating his previous statement that the satellite services "face a very high hurdle." He also repeated his previous assertion that a ruling will be made before the end of first quarter, noting that "we're just at the beginning of MARCH."
MARTIN said that the FCC "99 times out of 100" will wait for the JUSTICE DEPARTMENT to make a decision on antitrust issues before voting on a merger, and noted that the satellite merger is complicated by the wording of the original licenses that prohibits such a merger.
