Fox, NBCU: FCC Has No Right To Regulate Indecency

FOX and NBC UNIVERSAL have filed an intervenor brief with the Second Circuit Court of Appeals in ABC's "NYPD BLUE" case against the FCC charging that the Commission does not have the authority to ban indecency on broadcast media. Noting that the FCC issued its fine against ABC without a single actual viewer complaint, FOX and NBCU raise the issue of the V-chip and other more narrowly-tailored alternatives in asserting that "there is no longer any constitutional justification for continuing to ban the broadcast of indecent material."
ABC is battling $1.2 million in fines against the network and 45 affiliates for the "NYPD BLUE" case, in which a woma's bare backside was briefly glimpsed.
