FCC Rejects Challenge To New Mexico FM Grant

The FCC has upheld the grant of a new noncommercial FM in TUCUMCARI, NM to IGLESIA SHEKIRA over the objection of TRINITY BAPTIST CHURCH OF TUCUMCARI.
The church alleged that IGLESIA SHEKIRA violated the local public inspection and local notice requirements of the rules, and IGLESIA SHEKIRA replied with an Opposition that claimed it was never served the church’s objection. On the latter point, the Commission noted that, however it may have received the document, IGLESIA SHEKIRA did receive the church’s complaint; on the issues, the Commision said that TRINITY did not provide details as to how anyone might have been denied access to the application, and that evidence to the contrary exists. The FCC also noted that the permittee was late in publishing public notice but did substantially perform the notice under the requirements of the rules.
