Too Late, FCC Says In Dismissing Appeal Of Rejected Application

The FCC has rejected ANTONIO NASSAR's petition for reconsideration of its dismissal of his application for a new AM in BAY CITY, TX.
The filing was late, and NASSAR complained that he never received mailed notice of the dismissal, but the Commission noted that the dismissal was by public notice, published in the FCC Record, which constitutes adequate notice even without a decision letter.
The Commission also fined POWER RADIO CORP. $6,000 for airing ads on noncommercial low-power FM KXPW-LP/GEORGETOWN, TX. The fine was reduced from a proposed $20,000 due to inability to pay.
