FCC Rejects CBS Appeal Of WIP Wing Bowl Fine
August 26, 2009 at 10:46 AM (PT)
The FCC has upheld its $4,000 fine against CBS RADIO Sports WIP-A/PHILADELPHIA for disqualifying a contestant from its WING BOWL 13 eating competition for being a member of a professional competitive eating association other than the one working with the station on the annual event, basing the disqualification on an unannounced contest rule. CBS had appealed the fine but the Commission rejected its petition for reconsideration, saying that CBS raised no new issues nor demonstrated a material error or omission in the original order.
In another ruling, the FCC rejected MEDIATRIX SC INC.'s petition for reconsideration of a letter giving a rival mutually exclusive applicant, GEORGE M. ARROYO, a dispositive preference for an AM license in AM auction 84. The Commission called the preference letter an interlocutory order rather than a final ruling, and therefore not subject to petitions for reconsideration.
And the Commission fined WCRP/GUYAMA, PR licensee MINISTERIO RADIAL CRISTO VIENE PRONTO, INC. $2,000 for airing prohibited commercial advertisements on the noncommercial station.
