FCC Nixes Appeal Of Station's Facility Change

The FCC has dismissed HEARTLAND MINISTRIES, INC.'s Petition for Reconsideration of its dismissed application for a minor change to noncommercial WTRT/BENTON, KY.
The original application was dismissed because it technically conflicted with the analog signal of NBC affiliate WPSD-TV/PADUCAH, KY; HEARTLAND argued that its application was acceptable because it would not take effect until WPSD switched to a UHF channel in the digital transition. Another application for the same channel in a subsequent filing window was also dismissed for the same reason.
The Commission ruled that HEARTLAND's later obtaining of consent from WPSD should not be allowed because it was untimely and would prejudice the other application, which similarly would have been grantable had WPSD's analog license been removed at the time, because the HEARTLAND application, which was defective, would preclude the grant of the other application as well.
