Paul Finebaum's Suit Against Citadel Moving Back To State Court

Syndicated sports talker PAUL FINEBAUM's lawsuit against CITADEL BROADCASTING has been sent back from federal to ALABAMA state court, reports the BIRMINGHAM BUSINESS JOURNAL. FINEBAUM, based, for now, at now-CUMULUS Sports WJOX-A-F/BIRMINGHAM, had filed a motion to move the case back to state court after CITADEL moved it to federal court, and Judge L. SCOTT COOGLER granted FINEBAUM's motion, ruling that the case did not exceed the $75,000 federal threshold.
A separate motion by FINEBAUM's attorneys to dismiss a duplicative case in federal court was denied on procedural grounds but the judge noted that the case would also be remanded to state court if FINEBAUM adds claims made in the other suit.
FINEBAUM is alleging that CITADEL violated his contract by filing for bankruptcy without his prior permission, then coerced him into signing a contract amendment under duress. COX MEDIA GROUP has widely been reported to have made an offer to FINEBAUM to join its Sports WNCB (97.3 THE ZONE)/BIRMINGHAM if he can extricate himself from his WJOX contract.
