Arbitron, Magic Broadcasting Ink Lawsuit Settlement Agreement

ARBITRON has settled its lawsuit against MAGIC BROADCASTING, LLC and MAGIC BROADCASTING ALABAMA LICENSING, LLC. resolving the claims brought by the ratings service for copyright infringement and breach of license agreement.
ARBITRON sued MAGIC on NOVEMBER 16th, 2011, alleging that MAGIC improperly used proprietary or copyrighted ARBITRON materials, information, and data after its contract for ratings services expired. MAGIC, which has since exited the DOTHAN market, settled the suit for an undisclosed sum and agreed not to continue infringing ARBITRON's intellectual property rights, also acknowledging that its on-air personalities were not authorized to talk about the ratings; ARBITRON agreed not to pursue legal action against MAGIC as long as MAGIC complies with the settlement.
MAGIC sold its stations in DOTHAN in a complicated deal that sent Country WTVY-F and Top 40 WKMX to GULF SOUTH COMMUNICATIONS, Urban AC WBBK (MAGIC 93.1) to ALABAMA MEDIA INVESTMENTS, LLC, and WJRL (ROCK 104) and Adult Hits WLDA (STAR 100.5, now Urban 100.5 THE BEAT) to SOUTHEAST ALABAMA BROADCASTERS.
