After the FCC shot down GARY BURNS' 3 DAUGHTERS MEDIA's Petition to Deny filed against the sale of Talk WLNI/LYNCHBURG, VA by CENTENNIAL LICENSING, LLC to MEL WHEELER, INC. for $1,025,000 (NET NEWS 8/22), BURNS has filed a Petition for Reconsideration in the matter.
The new petition reiterates 3 DAUGHTERS' allegations that the deal would give WHEELER control of 10 stations in the market, six full-power FMs, two AMs, and two FM translators (including WVBB/ELLISTON-LAFAYETTE, VA, which 3 DAUGHTERS counts and BIA and the FCC do not), over the FCC's ownership caps. The new twist raised by the petition is that the FCC's AUGUST ruling agreed that one of three stations added to the market by BIA should not have been counted but the other two should, but one of those stations has again gone silent, which would reduce the number of stations home to the metro and reduce the caps. The petition also calls the use of ARBITRON and BIA market definitions arbitrary and capricious.
BURNS has also contacted Rep. BOB GOODLATTE (R-VA) for help in battling ARBITRON's proposed simulcast reporting changes and the sale of the company to NIELSEN.
