Photographer, Cumulus Settle Suit Over Use Of Photo On WABC/New York Website

Photographer RICHARD HARBUS and CUMULUS MEDIA have settled HARBUS' lawsuit against the broadcaster filed in U.S. District Court for the Southern District of NEW YORK alleging that News-Talk WABC-A/NEW YORK's website infringed his copyright on a photo of NEW YORK KNICKS' then-coach DEREK FISHER.
The alleged infringement came in FEBRUARY after FISHER was fired by the KNICKS; the photo had been licensed to the NEW YORK DAILY NEWS and CUMULUS allegedly posted the same photo without license or credit alongside an article about KURT RAMBIS' hiring as interim coach.
HARBUS was asking for statutory damages of $150,000 and attorney's fees and costs or alternative statutory damages of $2,500 per violation up to $25,000, but the terms of the settlement were undisclosed and the case has been dismissed without prejudice.
