KALI KANONGATAA, owner of the POLYNESIAN CULTURAL EXCHANGE in SAN FRANCISCO, has filed suits against CBS RADIO, CBS BROADCASTING, NBCUNIVERSAL MEDIA, LLC, AMERICAN BROADCASTING COMPANIES, INC. and YAHOO! INC. for copyright infringement, alleging that the defendants republished his video, the first live birth streamed via FACEBOOK Live, without permission.
The suit in U.S. District Court for the Southern District of NEW YORK claims that the video, available on KANONGATAA's FACEBOOK page, was reposted to the WCBS-TV/NEW YORK, WCCO-TV/MINNEAPOLIS, KOVR-TV/SACRAMENTO-STOCKTON, KVIL/DALLAS, WZMP (96.5 AMP RADIO)/PHILADELPHIA, TODAY SHOW, GOOD MORNING AMERICA, and YAHOO! websites, attached to an article about the birth and streaming. KANONGATAA is seeking damages and profits or up to $150,000 per work as statutory damages, plus attorney's fees and a permanent injunction.
