SIRIUSXM RADIO, INC. has been hit with another lawsuit for alleged violations of the Telephone Consumer Protection Act, this time by a plaintiff who opted out of the $35 million class action which the company is in the process of settling.
BINYAMIN PINKUS of ILLINOIS is the plaintiff in the suit filed by NEW JERSEY law firm MARCUS AND ZELMAN, LLC in U.S. District Court for the Northern District of ILLINOIS, alleging that the satellite radio company called his number and used a robodialer and prerecorded messages to solicit his business without his consent on "at least a hundred occasions." PINKUS is seeking $1,500 per violation (treble damages for each incident).
