Texas FM Sold In Settlement Of Dispute Over Another Sale

CAROLINE SMITH is selling Tejano KAMT (MEGA 105.1)/CHANNING, TX to MARIA CENICEROS' VIVA MEDIA, LLC in a settlement of SMITH's petition to deny VIVA's purchase of Rhythmic AC KQFX (WILD 104.3)/BORGER, TX from TEJAS BROADCASTING, LTD. LLP. In the settlement, VIVA, which has been programming KAMT under a time brokerage agreement since JULY 7, 2014 and leasing space on SMITH's tower for its Regional Mexican KBEX (LA PODEROSA 96.1)/DALHART, TX, will pay $351,000 for KAMT and will make a payment of $100,000 for past-due brokerage payments (to be credited towards the purchase price), while payments on VIVA's lease will be considered current through JUNE 30, 2017. VIVA will also have a two-year option to buy the tower for $700,000, and SMITH is dismissing her petition to deny the KQFX sale.
In other filings with the FCC, EDGEWATER BROADCASTING, INC. has applied for an STA to operate Silent W219DP/WEST DEERFIELD BEACH, FL from a new location after its lease expired. The station's license was deleted on SEPTEMBER 30th after a complaint from CALL COMMUNICATIONS GROUP alleged that the station had been off the air without authorization since at least early 2016; EDGEWATER initially filed for a Silent STA saying that the station went silent on MAY 7, 2017 but filed a second request changing the date to SEPTEMBER 23, 2016.
RED ZEBRA BROADCASTING LICENSEE, LLC has filed for an STA to operate Sports WSPZ-A (SPORTSTALK 570)/BETHESDA-WASHINGTON non-directionally at 25% power while work is done to diplex CUMULUS News-Talk WMAL-A/WASHINGTON on its towers. RED ZEBRA closed last week on the sale of WSPZ and its transmitter property to AM 570, LLC, an affiliate of SALEM, dor $2.1 million.
AKAL BROADCASTING CORPORATION has requested an STA to operate Punjabi KGSV-A (RADIO PUNJAB)/OILDALE, CA nondirectionally at 25% power after one of its towers was destroyed in a storm.
Asking for Silent STAs were JHONSON NAPOLEON's WJBW LLC (WJBW-A/JUPITER, FL, towers fell in Hurricane Irma); UNIVERSITY OF THE VIRGIN ISLANDS (WUVI-LP/JOHN BREWERS BAY, ST. THOMAS, VI, damage from Hurricane Irma); and PENFOLD COMMUNICATIONS, INC. (WKJA/BRUNSWICK, OH, transmitter failure).
Requesting extensions of Silent STAs were JAVIER FLORES (K282BF/ODESSA, TX, to save electricity pending a format change); CUMULUS LICENSING LLC (WCYN-F/CYNTHIANA, KY, lack of exciter); and RADIOJONES, LLC (WHCG-A/METTER, GA, delay on replacement tower construction due to Hurricane Irma).
CHARLES D. MARSH has closed on the sale of his 40% interest in ICON BROADCASTING, INC., licensee of Country WQDK (99.3 THE BULL)/GATESVILLE, NC, to partners MARK TARTE and DON WENDELKEN for $10,000; TARTE got 5 shares and WENDELKEN 3 shares to give each 50% of the company. MARSH has also closed on the sale of his 33.3% share of CDM BROADCASTING, INC., licensee of Country WZVA (103.5 THE BULL) and Classic Rock WOLD-F//MARION, VA, to TARTE and WENDELKEN as part of the same deal, giving each of the buyers 50% of that company as well.
MICHAEL WILKINS' SOUTHWEST ARKANSAS MEDIA, LLC has closed on the sale of Silent KDEL-F and Silent KVRC-A/ARKADELPHIA, AR; Sports KWPS-F (ESPN WPS)/CADDO VALLEY, AR; Country KYXK (KIX 106.9)/GURDON, AR; Silent KZYP-A/MALVERN, AR-K264AU/SHERIDAN, AR; and K229CX/BENTON, AR to MONTE SPEARMAN and GENTRY TODD SPEARMAN's HIGH PLAINS RADIO NETWORK, LLC for $550,000.
TODD ROBINSON's KZLZ, LLC has closed on the swap of K275CP/PHOENIX to VIC MICHAEL's MOUNTAIN COMMUNITY TRANSLATORS, LLC for K251CG/WILLCOX, AZ. K275CP rebroadcasts IHR EDUCATIONAL BROADCASTING Religion KIHP-A (IMMACULATE HEART RADIO)/MESA, AZ and K251CG rebroadcasts Classic Country KHIL-A/WILLCOX, AZ. MICHAEL's MOUNTAIN COMMUNITY TRANSLATORS, LLC has also closed on the sale of K230BZ/PUEBLO and K239CH/COLORADO SPRINGS to ROBINSON's UNITED STATES CP, LLC for $1,000. K230BZ rebroadcasts Oldies KWRP-A (CRUISIN' OLDIES)/PUEBLO and K239CH rebroadcasts Classic Hip-Hop KCBR-A (BLAZIN' 98.5)/MONUMENT, CO.
The FCC also cancelled SERENDIPITY VENTURES II, LLC's license for WSDT-A/SODDY DAISY, TN after an AUGUST 8th letter asking for evidence that the station did not remain silent for 12 months was returned as undeliverable on AUGUST 28th.
