TALK RADIO NETWORK is taking a shot at an appeal of the U.S. District Court's dismissal of its antitrust lawsuit against CUMULUS MEDIA, WESTWOOD ONE, COMPASS MEDIA NETWORKS, WYD MEDIA MANAGEMENT/WYM MEDIA MANAGEMENT, LEW DICKEY, and CHARLES STEINHAUER. TRN has filed an appeal notice on TUESDAY (9/19) with the Ninth Circuit Court of Appeals after Judge ANN L. AIKEN signed an order on SEPTEMBER 11th affirming the dismissal by Magistrate Judge MARK D. CLARKE of the case.
TRN's suit claimed CUMULUS and WESTWOOD ONE are monopolizing or attempting to monopolize the independent national syndication advertising representation market, and that WYD and WYM are "operated in collusion" with CUMULUS and WESTWOOD ONE. Judge CLARKE ruled in SEPTEMBER 2016 that a NEW YORK federal case precluded seven anti-trust counts in the present case, and that breach of contract claims lacked specificity.
