Appeals Court Upholds Invalidation Of Personal Audio 'Podcast Patent'

The U.S. Court of Appeals for the Federal Circuit has denied PERSONAL AUDIO, LLC's appeal of the invalidation by a three-judge panel of a patent it has claimed governs podcasting and has used to sue several parties for infringement.
ARS TECHNICA reports that the patent was invalidated by the U.S. Patent Office in 2015 after a challenge by the ELECTRONIC FRONTIER FOUNDATION and PERSONAL AUDIO appealed, with the three-judge panel upholding the invalidation in AUGUST of this year. An appeal to the full court has now ruled against PERSONAL AUDIO's patent in a terse decision handed down WEDNESDAY (11/3).
PERSONAL AUDIO had used the patent, which was asserted to cover downloading audio files to a player, to sue APPLE, ADAM CAROLLA, HOWSTUFFWORKS, and others; The CBS case saw a jury award PERSONAL AUDIO $1.3 million, and CAROLLA, who aggressively fought against the suit against his company, settled on a confidential basis.
