SIRIUSXM has filed to remove a subscriber's putative class action lawsuit from a NEW JERSEY court to federal court.
The suit was brought by DARLENE VAUGH, who filed her case in NEW JERSEY Superior Court, Law Division, ATLANTIC COUNTY, alleging that the satellite company's "lifetime subscriptions" came with hidden restrictions like a limited number of transfers and a $75 fee per transfer. SIRIUSXM did not respond to the MAY 8th suit but instead filed to remove the case to the U.S. District Court for NEW JERSEY, claiming subject matter and citizenship diversity and liability greater than $5 million, although it disputes the definition of the class affected.
