CHICAGO trial lawyer CARMEN D. CARUSO and employment lawyer GARY ABRAMS filed a complaint on behalf of KAREN HENDERSON, a LOUISVILLE-based sales pro, making a claim for defamation. The complaint was filed in the UNITED STATES DISTRICT COURT, WESTERN DISTRICT of KENTUCKY, LOUISVILLE Division, on AUGUST 6th.
Pointing out that HENDERSON was one of SKYVIEW’s top sales performers, the complaint alleges SKYVIEW SATELLITE NETWORKS INC. committed defamation against HENDERSON. The complaint alleges that on JULY 16, 2018, SKYVIEW’s EVP/GM JEANNE-MARIE CONDO, accessed HENDERSON’s contacts stored in the MICROSOFT OUTLOOK program on HENDERSON’s company owned laptop and emailed all of HENDERSON’s contacts announcing that SKYVIEW had placed HENDERSON on “administrative leave” and requested that no one contact her.
SKYVIEW is accused of sending this e-mail not only to HENDERSON’s professional business contacts including advertisers and her peers at other media companies, but also to her family, friends, and neighbors. The complaint alleges SKYVIEW had no factual basis to publicize this administrative leave in a way that purposefully implies HENDERSON had engaged in some unstated misconduct in relation to her job so serious it warranted administrative leave and quarantine. The complaint further alleges SKYVIEW has refused her demands for a retraction to every person that received the defamatory email.
“Ms. HENDERSON seeks damages for injury to her reputation and the harm to her earning capacity, emotional distress, and punitive damages,” said CARUSO. “We are demanding a trial by jury, and we notify the press in the hope news of this lawsuit will help restore KAREN HENDERSON’s good name."
