Another lawsuit has been filed against SIRIUSXM in U.S. District Court for Central CALIFORNIA, alleging that the satellite radio service violated the Telephone Consumer Protection Act by making telemarketing calls to his cellphone.
GERALD KOSTECKA of TEMECULA, CA filed the case TODAY (11/12), claiming that SIRIUSXM began calling his cellphone in MAY 2018 and would not stop doing so, including using a robocalling system, even after being told to stop calling. KOSTECKA is seeking $500 in statutory damages for each violation plus treble damages.
SIRIUSXM settled a previous class action over the same issue for $35 million, but other suits in have been filed by class members who opted out of the class.
