FCC Wants Another Crack At 'Nipplegate'

The FCC has filed with the U.S. Court of Appeals for the Third Circuit to review the 2004 JANET JACKSON SUPER BOWL halftime "wardrobe malfunction" broadcast indecency case in light of the SUPREME COURT's decision last year on "fleeting expletives."
The Commission originally fined CBS television a total of $550,000 for broadcasting the breast-baring incident, but the Third Circuit overturned and remanded the case. Upon appeal, the case was sent by the SUPREME COURT back to the Third Circuit for further review.
