Fox Files Brief In 'Fleeting Expletives' Appeal

FOX has filed its brief with the Second Circuit Court of Appeals challenging the FCC's indecency rules in the "fleeting expletives" case remanded to the appeals court by the Supreme Court earlier this year, and the network asserts that the Supreme Court ruling should be vacated and broadcasters should have the "same First Amendment protection as other media." 

FOX contends that the application of the indecency rule to the BILLBOARD Music Awards broadcasts violates the constitutional because the network had no intent to violate the rule and the show was unscripted, removing the element of knowledge from the equation.
