FCC OKs Sale Of WHEO

The FCC has approved the assignment of Classic Country-Bluegrass WHEO-A/STUART, VA from MOUNTAIN VIEW COMMUNICATIONS, INC. to PATRICK COUNTY COMMUNICATIONS, L.L.C. for $150,000 (less than the seller owed in mortgage and taxes) after adopting a Consent Decree with H. DEAN GOAD, 50% owner, Co-Manager, and Member of the buyer over unauthorized transfer of control of the Station.
MOUNTAIN VIEW Pres. JAMIE T. CLARK pleaded guilty to child pornography charges in 2008 and was sentenced to three years in prison; the Commission uncovered evidence that control of the station was transferred several times without prior FCC approval since 1986, with GOAD ultimately acquiring 100% of the shares of the seller without FCC authority. In 2000, GOAD sold 24.5% of the shares to CLARK and 24.5% to RICHARD ROGERS, who sold his share to CLARK. GOAD sold his remaining 51% to CLARK in 2005 without filing the deal with the FCC; after CLARK ran into his legal and financial trouble and faced foreclosure by GOAD, CLARK filed to sell the station to GOAD and TOM BEASLEY’s PATRICK COUNTY COMMUNICATIONS.
The Commission agreed to allow CLARK to sell the station because he will not receive any direct benefit from the sale other than the possible satisfaction of a portion of his tax liability, and because the FCC determined that the sale and continued operation of WHEO would be in the public interest. Regarding the unauthorized transfers of control, the Commission declined to prosecute the issue further but GOAD will pay $8,000 to the U.S. Treasury under the consent decree to settle the matter.
Commission OKs Texas Station's Antenna Move
The FCC has also rejected MUNBILLA FORT HOOD, LTD.’s objection to PROPHECY MEDIA GROUP, LLC‘s move of the antenna of KDRW/HEWITT, TX. The objection centered on the availability of the specified tower site and an FAA notice of presumed hazard for the location.
In addition, the Commission cancelled a proposed fine against RICHARD P. MARBURGER for a late license renewal application and unauthorized operation of FM translator W232AI/NILES, OH but admonished MARBURGER for the violations; and fined CALVARY CHAPEL OF TWIN FALLS, INC. $500 for late license renewal applications for translators K201FP/ARAPAHO, OK and K216FR/CLINTON, OK.
