CLEAR CHANNEL Rock WHJY/PROVIDENCE has lost a bid to be dismissed as a defendant in a civil lawsuit brought by survivors and families of victims of the STATION nightclub fire in FEBRUARY 2003. WHJY host MICHAEL "DR. METAL" GONSALVES died in the fire; the station was included in the suit because it advertised the GREAT WHITE concert, hung banners outside the show, and gave away tickets to the event. U.S. District Judge RONALD LAGUEUX said that the station might be liable if the plaintiffs can establish that it had control over the planning and execution of the concert and failed to prevent the indoor fireworks that ignited the blaze from occurring.
