Report: Finebaum-Citadel Settlement Talks Fail

The BIRMINGHAM BUSINESS JOURNAL reports that settlement talks in PAUL FINEBAUM's suit against CITADEL BROADCASTING CORP. have failed, and FINEBAUM has filed a motion to move the case back to county court.
In filings with the Federal court on FRIDAY (9/2), FINEBAUM, the syndicated sports host based, for now, at CITADEL Sports WJOX-A-F/BIRMINGHAM, denied CITADEL's counter-allegations that he had been erroneously overpaid between 2007 and 2010. The removal motion asked that the case be sent back to JEFFERSON COUNTY Circuit Court.
FINEBAUM is alleging that CITADEL violated his contract by filing for bankruptcy without his prior permission, then coerced him on FEBRUARY 16th into signing a contract amendment under duress. He is asking to be paid everything he would have gotten without the amendment. Two suits were filed, but FINEBAUM's attorney has moved to dismiss the first due to failure to name one of the defendants; it was left active due to a clerk's error.
The JOURNAL is also reporting that COX MEDIA GROUP has made an offer to FINEBAUM to join its new Sports WNCB (97.3 THE ZONE)/BIRMINGHAM, with a multiyear offer contingent on the host getting released from his CITADEL contract. FINEBAUM, who CITADEL contends is under contract through JANUARY 2013, would remain in the same 2-6p (CT) time slot if he was to move to THE ZONE.
