A three-judge panel of the 9th Circuit voted 2-1 that someone who posted a call to shoot the president and added racial epithets can't be punished for that, because he's protected by the First Amendment. The idea is that context is everything: They said that a reasonable interpretation of what he wrote would not lead one to believe he really planned an assassination. And maybe that's the case, because it's rare that a murderer tells people he's going to do it before he does. But can you just look the other way when someone says something like that?
