New York places heavy taxes on cigarettes. Some entrepreneurs have exploited a loophole by opening shops that let customers roll their own cigarettes. The shops sell tobacco papers, and have counters where customers make their own cigarettes. And now the city is suing the shops in an attempt to collect those taxes. The city likens the places to salad bars, saying that the product being purchased is a salad, not the individual pieces of produce. But if they intended to tax tobacco and paper, shouldn't they have written the law that way? (New York Times)
