Pat Campbell at KFAQ/Tulsa draws our attention to the story of Michael Behenna, the soldier who has lost an appeal of his unpremeditated murder conviction in a case that has some people very upset. The murder, for which he's serving 15 years in prison, involved his taking a detainee to a railroad culvert and interrogating the man about a fatal roadside bombing, then allegedly shooting him "execution-style." Behenna claims it was self defense after the guy threw a rock at him and went for his gun, and that the judge screwed up and unfairly blocked his self-defense evidence, including prosecutors not telling him that an expert witness on crime scenes would have supported his version of events had the expert testified. The court says that it was irrelevant because he "gave up his right to claim self-defense" when he pointed a gun at an unarmed, naked prisoner.
