Remember the woman who jaywalked with her baby and got hit by a drunk driver, killing the child, and ended up convicted of vehicular homicide herself? She's lost an appeal to the state Supreme Court to halt further prosecution. And it raises the same questions we had before: Was the jaywalking more of a reason for that baby's death than the drunk driving? Do you prosecute a woman who made a mistake that led to a baby's death or is the loss its own punishment? Was jaywalking justified because the crosswalks were a half-mile in either direction?
