That 'One Too Many' Drink Is Like Loading A Weapon

New York's highest court is considering an interesting question: is it possible to be too drunk to murder? In this case, a pickup truck driver drank for nearly 10 hours, got behind the wheel, drove two and a half miles in the wrong direction, and hit a limousine, killing the other driver and a seven-year-old girl who was sleeping at the time. There's no question that he's responsible for two innocent deaths. But the court is considering whether he was too drunk to have the state of depravity in his mind to kill somebody. Should somebody who gets so drunk that he can kill people, regardless of whether he knew he was doing it at the time or not, be convicted of murder or get away with it? I'd argue that when you drink that much, you know or should know that something like this can happen. The state of mind at the very moment of death isn't as important as the state of mind when you start the events that lead to that death. (WNYT-TV/Albany)
